Welcome to CAGunTrader.com (the “Site”), with a registered address at PO BOX 3776, Glendale, CA 91221 operated by MAD COMPANY LLC (“CAGunTrader,” “we,” “us,” or “our”). The terms “Site,” “CAGunTrader,” “CAGunTrader.com” and “MAD COMPANY LLC” are entirely interchangeable for purposes of the below acknowledgment by the end user of the Terms & Conditions of Use.

By accessing, browsing, or using this Site, you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions of Use (“Terms”) and our Privacy Policy.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY DISCONTINUE USE OF THIS SITE.

1. Eligibility

1.1. You must be at least 21 years of age or the minimum age required by the state of your residence to purchase or possess a firearm, whichever is greater.

1.2. By using this Site, you represent and warrant that you are of legal age, competent to contract, and not prohibited under state or federal law from possessing or purchasing firearms or ammunition.

1.3. You must comply with all applicable federal, state, and local laws, including those governing firearm transfers, background checks, and dealer requirements.

1.4. You expressly agree that all transactions and/or transfers will take place with a Federally Licensed Firearms Dealer (FFL). 

1.5. You agree that regardless of your transaction on CAGunTrader.com, you may be denied or otherwise ineligible to purchase a firearm upon background check for those items requiring such. CAGunTrader.com makes no guarantees or warrantees on your individual ability, legal or otherwise, to purchase and/or possess a firearm or pass a background check. 

2. Platform Purpose and Disclaimer

2.1. CAGunTrader.com is a listing and communication platform only.

       We do not broker, sell, ship, or handle firearms or ammunition directly.

       All transactions and transfers must be conducted in compliance with federal and state law, including transfer through a Federally Licensed Firearms Dealer (FFL) where required.

2.2. We do not verify, warrant, or guarantee:

       2.2.1. The legality of any listing;

       2.2.2. The ownership or condition of any firearm or item;

       2.2.3. The qualifications, identity, or intent of any user; or

       2.2.4. The completion or outcome of any transaction.

       2.2.5. Users assume all risk related to interactions and transactions conducted through the Site.

3. No Agency or Warranty

3.1. CAGunTrader.com is not an agent, broker, escrow provider, or guarantor for any user.

3.2. We do not control and are not responsible for the quality, safety, legality, or accuracy of listings or transactions.

3.3. All sales are conducted solely between the buyer and seller.

3.4. THE SITE AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

4. User Accounts

4.1. To post listings or communicate with other users, you may be required to create an account.

4.2. You agree to:

       4.2.1. Provide accurate, current, and complete information;

       4.2.2. Maintain the confidentiality of your account credentials; and

       4.2.3. Be solely responsible for all activities under your account.

4.3. CAGunTrader.com reserves the right to suspend or terminate any account that violates these Terms or applicable law, without and prior warning or notification.

4.4. We reserve the right to suspend or terminate your access to CAGunTrader.com at our discretion, without notice and for any reason, including if you violate these Terms.

6. Posting Content

6.1. Users may post classified listings for firearms, accessories, and related items on CAGunTrader.com. You are solely responsible for the accuracy and legality of any content you post on the Website.

6.2. By posting content on CAGunTrader.com, you grant MAD COMPANY LLC a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content.

6.3. You agree not to post any content that is unlawful, defamatory, infringing, harassing, obscene, fraudulent, or otherwise objectionable. We reserve the right to remove any content that violates these Terms.

7. Disclaimers

7.1. CAGunTrader.com is a platform for classified listings, and we do not endorse or guarantee the accuracy, legality, or quality of any listings or transactions between users.

7.2. We do not provide legal advice, and all users are responsible for complying with all applicable laws and regulations regarding firearms.

7.3. We reserve the right to modify these Terms at any time by posting the revised Terms on the Website without prior notice to the user. Your continued use of CAGunTrader.com after such changes will constitute your acceptance of the updated Terms. 

8. Limitation of Liability

To the extent permitted by law, MAD COMPANY LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use or inability to use CAGunTrader.com.

To the fullest extent permitted by law:

CAGunTrader.com, and its affiliates, owners, officers, employees, agents, and licensors (collectively, “CAGunTrader Parties”) shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising out of or related to your use of the Site, even if advised of the possibility of such damages.

MUST READ: It is the responsibility of each user to ensure they are maintaining a reasonable degree of safety when engaging in transactions/ transfer of firearms. Each user acknowledges it is their responsibility to take precautions, and use their best judgment Regarding safety or otherwise when transacting with unfamiliar individuals. Any personal information used and/ or provided from user to is done so at the risk of each user. All users expressly agree and acknowledge that the Site Except no responsibility, liability, make any guarantee or warranty of the end users’ personal safety.

It is strongly recommended that all transactions of money and, as required by law, all transfers of firearms always be conducted during normal business hours, within premises of a Federally Licensed Firearms Dealer (FFL). 

9. User Responsibilities

You agree that you will not use the Site to:

       9.1. Post or solicit the sale of any firearm, part, or ammunition in violation of any applicable State and Federal law;

       9.2. Facilitate or engage in “straw purchases” or unlicensed transfers;

       9.3. Misrepresent any product, condition, price, or ownership;

       9.4. Post unlawful, defamatory, threatening, harassing, or misleading content;

       9.5. Infringe on another’s intellectual property rights;

       9.6. Upload or distribute viruses, malware, or harmful code; or

       9.7. Interfere with or disrupt the operation or security of the Site.

       9.8. All users are responsible for ensuring that their listings and transactions fully comply with the all State and Federal Laws, including those of the California Penal Code sections governing firearms.

10. Compliance with Laws

All users are solely responsible for:

       10.1. Ensuring all firearm transfers are completed through a Federally Licensed Firearms Dealer (FFL) where required;

       10.2. Conducting all required background checks and complying with waiting periods;

       10.3. Complying with all state registration and reporting requirements; and

       10.4. Refraining from shipping firearms or ammunition in violation of federal or state law.

11. CAGunTrader.com assumes no responsibility or liability for any illegal conduct by users.

12. Listing Rules

12.1. Listings must include truthful and lawful descriptions of the items.

12.2. Sellers must ensure that any listed firearm is legal for sale in the buyer’s jurisdiction.

12.3. No listings for:

       12.3.1. Illegal firearms (e.g., NFA-regulated items without proper license);

       12.3.2. “Ghost guns” or unserialized receivers (unless fully compliant under California law);

       12.3.3. Firearms prohibited under California’s Assault Weapons Control Act;

       12.3.4. Ammunition or magazines exceeding legal capacity limits; or

       12.3.5. Explosives or destructive devices.

We reserve the right to remove any listing or suspend any user, at our sole discretion, without notice or refund.

13. Indemnification

You agree to indemnify, defend, and hold harmless CAGunTrader.com, its affiliates, owners, employees, agents, contractors, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from or related to: Your use or misuse of the Site; Your violation of these Terms or any applicable law; Your listing, sale, or purchase of any firearm, ammunition, or related item; or Any dispute between you and another user.

14. Agreement to Arbitrate, Governing Law & Dispute Resolution

By use of this website, you are expressly agreeing to the following: Any controversy arising out of or pertaining to this contract, or its scope, interpretation, application, enforcement, or alleged breach, shall be resolved through binding arbitration administrated through an arbitration provider in LOS ANGELES COUNTY, CALIFORNIA unless otherwise agreed upon. Each side shall bear the expense of the arbitration proceeding equally unless otherwise agreed upon. The arbitration proceedings shall be governed by California Code of Civil Procedure 1280 et seq. in effect at the time of arbitration or any other rules the parties mutually agree upon in writing.  Any award of the Arbitrator(s) may be entered as a judgment in any court having jurisdiction.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

15. Privacy and Communications

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect user information. By using the Site, you consent to receive electronic communications regarding your account and transactions.

These Terms, along with the Privacy Policy, constitute the entire agreement between you and CAGunTrader.com (the “Site”), operated by MAD COMPANY LLC concerning your use of the Site.
